泰汉律师事务所祝所有读者新年快乐！ 2021年1月1日以后前来英国的欧盟人士的移民选择 2020年12月发生了许多重要事件。最重要的事件之一是，英国和欧盟最终达成了脱欧协议，该协议详细规范了英国在2020年12月31日过渡期结束后与欧盟的未来关系。所有欧盟、欧洲经济区（EEA）和瑞士公民一直以来都很关注2021年1月1日起入境英国需要何种签证。尽管大多数申请人满足EU Settlement Scheme条件的日期已过，但我们为希望在新年前来英国的欧盟、欧洲经济区（EEA）和瑞士公民列出了其他可以选择的移民途径。 自2021年1月1日起实施新的移民政策后，在移民方面，所有欧盟公民和非欧盟公民在英国均享有同等待遇。除非您符合EU Settlement Scheme的申请资格，否则您将需要申请相应签证才能在英国合法居住。如果您或您的近亲属在2021年1月1日之前开始在英国居住，则可以在EU Settlement Scheme项下提交申请。否则，您将需要申请其他签证才能在英国居住、学习和工作。 根据您在英国居住的计划不同，您可以申请以下类别的英国签证： 工作签证 学生签证 投资移民签证 创业者/创新家签证 全球人才签证 EU Settlement Scheme 跨境工作许可 (Frontier Worker Permit) 工作签证和海外公司首席代表签证 对于希望在英国工作的申请人，您在前往英国为准雇主工作前，需要申请工作签证。您的准雇主必须是内政部注册的、有工签担保人资质的公司。并且您的职位必须满足必要的技能水平和薪资要求。 如果您受雇于一家在英国没有任何分支机构或者子公司的欧盟公司，并且您的雇主计划派您到英国进行业务活动并开设英国分支机构，那么您可以申请海外公司首席代表签证。 学生签证和儿童学生签证 根据您的年龄和您或您的孩子计划学习的课程不同，您可以申请学生签证或儿童学生签证来英国学习。您将需要获得内政部注册的、有学生担保人资质的学校支持，才能担保您的学生签证或儿童签证。您学习的课程可以是学龄级别的，也可以是大学级别的。 投资移民签证 如果您或您的配偶拥有至少200万英镑的投资资金，也可以考虑申请投资移民签证。您将需要在英国开设银行帐户并在英国进行投资，并且在签证期间保持该投资水平。您可以自由在英国工作，学习和居住。 您可以凭此签证前往英国，首次签证时长为3年4个月，到期后可将该签证再延长2年。根据您投资的金额，在某些情况下，您可以在2或3年后获得永久居留权。 创业者以及创新家签证 如果您是公司的创始人，计划前往英国开展业务， 并且您是一位有经验的企业家，有机会获得至少5万英镑的投资，那么创业者签证是另外一个选择。如果您想在英国初次创业，也可以申请创新家签证。创业者签证和创新者签证的商业计划必须得到英国移民局注册机构或者英国大学的认可，才可申请。 创新家签证的有效期为2年。2年后，您需要将签证转为创业者签证。 如果您已经持有创业者签证，并且满足移民局的各项要求，那么3年后即可申请永久居留权。 全球人才签证 如果您在专业领域有特殊成就，那么全球人才签证是您的另一选择。 您需要英国移民局认可的机构背书您在科学、人文、工程、医学、数字技术或艺术领域的成就和才能，来申请此类签证。 并且您必须是行业内公认的领导者或潜在的领导者。 该类签证的有效期为1至5年。如果您是行业领导者，可以在3年后申请永久居留权。如果您是行业潜在的领导者，则需要在5年后申请永久居留权。 EU Settlement Scheme 如果您至少在2020年12月31日开始在英国居住，现在希望申请“pre-settled status” 或者“settled-status”，申请截止日期为2021年6月30日。如果在2020年12月31日之前，您曾经在英国居住过，并且去年离境英国不到6个月。那么根据您在英国的居住历史，您可能有资格获得“pre-settled status”。 如果您曾经在英国居住满5年，并且没有丧失您的永久居留权，那么您也可以在EU Settlement Scheme项下重新申请永久居留权。 如果您打算前往英国，与在2020年12月31是前或当天开始在英国居住的欧盟家庭成员会和，您也可以在EU Settlement Scheme项下提交申请。请点击此处查看我们的文章，了解更多信息。 跨境工作许可…
