Indefinite Leave To Remain
Indefinite Leave to Remain (ILR) means permanent residence or settlement in the UK. Permanent residence is desirable because it brings a host of new rights, including the right to vote and access to public funds and benefits. It also takes away the worry of reapplying for visas and potential rejection.
The other great advantage to having permanent residence is that you will be entitled to apply Naturalisation as a British citizen after a year. This means you will have a British passport.
Permanent residence is granted to people on temporary visas who have shown a commitment to the UK and have been here legally for a number of years. The period of time to qualify for permanent residence varies from from 3 years for certain visas holders, to 10 years for those who have legally stayed on any basis.
There is the possibility of an accelerated route for some, including investors, who may qualify for permanent residence after 2-3 years. Innovators and Global Talent visa holders may be able to qualify after 3 years.
As well as the visa requirements and a certain length of stay, if you wish to qualify for permanent residence in the UK, you will have to satisfy the following:
- demonstrate you have sufficient knowledge of the English language.
- pass a test is to show you have sufficient knowledge of life in the UK. Applicants under the age of 16 or over 65 when they apply are exempt from these requirements.
Once you are granted permanent residence in the UK, you should try not to spend more than 2 years outside the UK as this can lead to your Indefinite Leave to Remain being revoked. To avoid this, many people opt to become British citizens after a year.
