Patrick Daulby is a partner at the firm of Taylor Hampton with a wide ranging commercial litigation practice, at present mainly involving solicitor and clinical negligence claims. As a litigator with over 30 years of experience, Patrick has over the years dealt with most areas of litigation. He frequently acts in cases with an overlap between disciplines.


Patrick specialises in unravelling complex and acrimonious situations, frequently taking over litigation that has gone badly wrong. His first case as a consultant at Taylor Hampton involved managing five actions in which the claimants had been wrongly advised on their prospects of success. Patrick fought the adverse costs order made against them whilst simultaneously bringing negligence actions against their solicitors.

Patrick continues to take on complex cases, manage litigation on several fronts and reach successful resolutions for his clients. He is well versed in cases involving complicated cross border elements, having acted in the lengthy litigation between the co-producers of Michael Radford’s Spanish-language film project, “La Mula”


Solicitor’s negligence

Thanks to his experience across a range of disciplines, Patrick is able to act for clients wishing to sue their former solicitors in negligence in a wide variety of claims, including property matters, commercial disputes involving companies and partnership including non-contentions work and probate litigation. This type of work also requires a good understanding of insolvency law.

Patrick has also developed a special expertise in solicitors’ costs. This includes assessments between parties at the conclusion of litigation which is often one of the consequences of negligently conducted litigation. He deals with solicitor/client detailed assessments for clients w ho wish to challenge their former solicitors’ bills.


Clinical negligence

Patrick regularly acts for claimants in clinical negligence claims. This is often difficult litigation where one has not only to establish breach of duty but also that the negligent conduct of the medical practitioners caused the claimant’s injuries. In appropriate cases, we will act on a Conditional Fee basis. As a corollary to his negligence practice, Patrick will also act in complex personal injury litigation.


Phone hacking, defamation and privacy

In recent years, Patrick has become involved in privacy litigation as a result of his involvement in phone hacking litigation, acting in high profile cases such as the NightJack case, where the Times Newspaper was successfully sued for hacking anonymous blogger Richard Horton’s computer, and John Leslie’s claims against News Group Newspaper for having hacked his phone in the early 2000’s.

Patrick has also dealt with numerous other defamation claims. He has experience of acting quickly to prevent publication of stories that are either defamatory or in breach of his client’s privacy.


Other areas

Patrick has experience in intellectual property litigation.

He has recently won the case of UWUG Limited & Anr v Derek Ball[2013] EWPCC 35.

As part of his commercial litigation practice, Patrick acts in actions against major banks for mis-selling of financial products.
